Terms and Conditions

Goods sold by Crawl Space Warehouse are subject to the Terms and Conditions of Sale stated below.  Any different or additional terms or conditions provided in a purchase order or similar communication shall not be a binding agreement with Crawl Space Warehouse unless specifically agreed to in writing by an authorized corporate officer of Crawl Space Warehouse.  Crawl Space Warehouse may revise these Terms and Conditions of Sale at any time without notice.  By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Sale.

Price :  Prices or products in effect at time of shipment are non-negotiable.  All prices presented by Crawl Space Warehouse are subject to change without notice.  Prices do not include any present or future sales, use excise, valued added, or similar taxes and, where applicable, such taxes shall be billed as a separate item and paid by the Buyer.

Orders:   An order submitted through the Crawl Space Warehouse website constitutes an offer by the Buyer to enter into a purchase and sale contract with Crawl Space Warehouse upon the terms and conditions set forth in these Terms and Conditions of Sale.  Crawl Space Warehouse will not be bound by any order until such time as Crawl Space Warehouse receives and fills the order.

Shipping Terms:  Unless otherwise noted, all sales are made f.o.b. point of shipment and, in all cases, title shall pass to Buyer upon delivery to the carrier at point of shipment and thereafter all risk of loss or damage shall be upon the Buyer.

Standard Ground Shipping:  If “Standard Ground Shipping” is selected, the carrier and method will be selected at the discretion of Crawl Space Warehouse.  This may include shipping the order in multiple shipments.  Any requests to be shipped by any other shipper or method will be considered a special shipment and require an additional shipment charge for the difference of the “Standard Ground Shipping” charge already applied and the shipping charge for the special shipping carrier/method.  The “Standard Ground Shipping” rate does not include freight accessorial charges such as inside delivery, lift gate, or residential.  If those are required for delivery, additional charges will apply and will need to be paid prior to shipment.

Delivery:   Delivery dates given in advance of actual shipment are estimates and shall not be deemed to represent fixed or guaranteed delivery dates.   Crawl Space Warehouse shall not be liable for failure to deliver or delay in delivery or performance because of: (i) circumstances beyond its reasonable control: or (ii) and act of God, act of omission of Buyer, act of civil or military authority, governmental priority or other allocations or control, fire, strike, or other labor difficulty, riot or other civil disturbance, insolvency or other inability to perform by the manufacturer or delay in transportation; or (iii) any other commercial impracticality.  In the event of any such delay, the date of delivery or performance shall be extended for a period to the time lost by reason of delay.

Freight Damages and Shortages:   No reduction from invoice may be made for loss or damage in transit.  When the originating carrier accepts your shipment, it assumes full responsibility for your order’s delivery.  Should loss or damage occur, file your claim with the carrier.  Concealed damage or shortage claims must be filed within 48 hours of receipt of shipment. 

Returned Merchandise:   New merchandise (in original packaging) may be returned with our prior written authorization and must be accompanied by the original invoice.  Returns without written authorization will not be accepted; No merchandise may be returned more than 30 days from the invoice date.  All returns are subject to a minimum of $5.00 or 15% restocking charge (whichever is greater).

Warranty Disclaimer:  Crawl Space Warehouse make NO warranty claims whether expressed or implied.  We honor the specific warranty made by a particular manufacturer of the item and no more.  We will not be responsible for labor involved with replacing a defective product or part.
